A Regularização Fundiária Urbana como Instrumento Eficacial do Princípio da Função Social da Propriedade e a Ideologia Constitucionalmente Adotada

The article presents an analysis on urban land policy and urban adjustment. The research problem is to verify the effectiveness of the principle of the social function of property according to "constitutionally adopted ideology" in urban land regularization of private property. The study aims to analyze the social function of property in accordance with the constitutionally adopted ideology, to describe the procedure of urban land regularization of social interest on private property and demonstrate how the land regularization serves as an effective mechanism of the social function of property. The deductive method was employed for this study.O artigo tem como tema a política urbana e a regulação urbanística. O problema da pesquisa consiste em verificar a eficácia do princípio da função social da propriedade de acordo com a “ideologia constitucionalmente adotada” na regularização fundiária urbana sobre imóvel privado. O trabalho tem por objetivos analisar a função social da propriedade de acordo com a ideologia constitucionalmente adotada, descrever o procedimento da regularização fundiária urbana de interesse social sobre imóvel privado e demonstrar como a regularização fundiária serve de mecanismo eficacial da função social da propriedade.
