Ograniczenia możliwości korzystania z praw zagwarantowanych w Międzynarodowym pakcie praw gospodarczych, społecznych i kulturalnych na podstawie jego art. 4 a progresywna realizacja tych praw

Article 4 ICESCR is rarely applied or commented on. One of the most controversial issues regarding the understanding and application of this provision is its relation to the principle of the progressive exercise of rights covered by the Covenant. The key question comes down to whether or not any shortcomings in the possibility of exercising the rights contained in the Covenant, and thus also shortcomings related to the limited availability of resources and the resulting inability of the state to fully implement any of the rights or freedoms, should be understood as limitations and thus evaluated under Article 4 and the admissible criteria for limitations contained therein. The question becomes even more pertinent with regard to the introduction of so-called retrogressive measures, which are introduced by states when resources are limited. Should such measures be assessed under Article 4 ICESCR and the criteria stipulated therein, or do they fall under a different order and thus need to meet other conditions? This paper is an attempt at a delimitation of the issues associated with the lack of full enjoyment of Covenant rights by entitled persons due to limited resources, and as a result of other legitimate aims pursued by the States. The article shows how the justification of such a delimitation is based on travaux préparatoires, on the text of the Covenant itself, and on its protective function. In this paper, the way in which this delimitation can be made more precise by proper application of the communications procedure, especially when it comes to a proper understanding of Article 8(4) of the Optional Protocol, will be proposed.Artykuł 4 Międzynarodowe paktu praw gospodarczych, społecznych i kulturalnych (MPPGSK) jest rzadko stosowany i komentowany. Jedną z najbardziej kontrowersyjnych kwestii związanych z rozumieniem i stosowaniem tego przepisu jest jego relacja do zasady progresywnej realizacji praw zawartych w Pakcie. Zasadnicza wątpliwość wiąże się pytaniem, czy wszelkie niedobory w możliwości korzystania z praw zawartych w Pakcie, a więc również te związane z ograniczoną dostępnością zasobów i wynikającą stąd niemożnością po stronie państwa pełnej realizacji któregoś z praw czy wolności, należy rozumieć jako ograniczenia i oceniać je pod kątem art. 4 i zawartych w nim kryteriów dopuszczalności ograniczeń, czy też nie. Wiąże się to szczególnie z pytaniem, czy wprowadzanie przez państwa tzw. środków retrogreasywnych, w sytuacjach gdy dostępne środki kurczą się, powinny podpadać pod reżim art. 4 MPPGSK, czy należą do innego porządku i podlegają innym wymogom. W tekście podjęto próbę rozgraniczenia kwestii związanych z niepełną możliwością korzystania przez podmioty uprawnione z praw zagwarantowanych w Pakcie wynikających z niedoboru zasobów oraz tych, które wynikają z realizacji przez państwa innych uprawnionych celów. Ukazano uzasadnienie takiego rozgraniczenia wynikające z prac przygotowawczych nad MPPGSK, jego z treści, a także z jego ochronnej funkcji. Podjęto również próbę wskazania drogi do doprecyzowania rozgraniczenia znaczenia art. 2 ust. 1 MPPGSK i art. 4 MPPGSK przez właściwe podejście do procedury skargowej na gruncie tego dokumentu, a szczególnie właściwe rozumienie art. 8 ust. 4 Protokołu ustanawiającego procedurę skargową
