Les dynamiques du contentieux climatique : anatomie d'un phénomène émergent

The assessment of the trial as a means of amicably settling conflicts with a view to promoting "social peace" is an interesting hypothesis to be developed in the case of climate litigation, where the overall problem of climate change is met with strong resistance international, regional and often national level. The courtroom has become the locus of resolution of certain disputes related to this global phenomenon with national or local repercussions. This reflection invites us to come out of a binary conception of rights, founded on an original dichotomy between the law and the praetorium, in order better to grasp all the social complexity of the creation of the law, especially in the case of a multi-faceted problem such as climate change. At the same time, and because of the case of climate change, the scope of a fundamental right of everyone to "a healthy and safe environment for the survival of mankind" emerges strongly, expectations climate justice and new rights to the impacts of climate change on society. This need for justice in subjective rights is in keeping with the growing importance of fundamental rights, which implies increased responsibilities for the State (based on international obligations but also regional and national obligations) and for business and industry. In this context, the courtroom becomes the place where citizens, associations, local authorities, victims of climate change, demand the commitment of the responsibility of the State and / or companies emitting GHG) or at least a change behavior, in the name of a right to a healthy environment, a duty of care of the citizens towards the citizens (Duty of Care) or calling for the application of the Public Trust doctrine.L'appréciation du procès comme mode de règlement amiable des conflits, en vue de favoriser la « paix sociale », est une hypothèse intéressante à développer dans le cas du contentieux climatique, dans lequel le problème global des changements climatiques se heurte à de fortes résistances législatives au niveau international, régional et souvent national. Le prétoire est devenu le lieu de résolution de certains litiges liés à ce phénomène mondial aux répercussions nationales ou locales . Cette réflexion invite ainsi à sortir d’une conception binaire des droits, fondée sur une dichotomie originelle entre la loi et le prétoire, pour mieux saisir toute la complexité sociale de la création du droit , surtout s’agissant d’un problème multi-facette comme les changements climatiques. Parallèlement, et parce que le cas du changement climatique fait émerger avec force la portée d’un droit fondamental de tous et de chacun à « un environnement sain et sans danger pour la survie de l’humanité » , on assiste au développement d’attentes nouvelles en matière de justice climatique et de nouveaux droits face aux impacts des changements climatiques sur la société . Ce besoin de justice en droits subjectifs concorde avec la place grandissante des droits fondamentaux supposant l’imposition de responsabilités accrues à l’État (fondées sur des obligations internationales mais également régionales et nationales) et aux entreprises et à l’industrie . Dans ce contexte, le prétoire devient le lieu où les citoyens, les associations, les collectivités territoriales , victimes du changement climatique, réclament l’engagement de la responsabilité de l’État et/ou des entreprises émettrices de GES) ou du moins un changement de comportement, au nom d’un droit à un environnement sain, d’un devoir de diligence de l’État envers les citoyens (Duty of Care) ou encore en appelant à l’application de la Public Trust doctrine
