Artikel ini bertujuan untuk mengungkap dan menganalisis implementasi pelaksanaan lelang tanah jaminan yang terikat hak tanggungan. Metode yang digunakan adalah yuridis normatif. Dengan metode tersebut ingin digambarkan hak tanggungan sebagai salah satu jenis jaminan kebendaan. Meskipun tidak dinyatakan dengan tegas, jaminan kebendaan adalah lahir dari suatu perjanjian. Undang-undang hak jaminan menentukan bahwa pada dasarnya pemberian hak tanggungan hanya dimungkinkan jika dibuat dalam bentuk perjanjian yang memenuhi syarat sahnya perjanjian.
