COLLECTIVE JU STICE AS AN ORGANIZATIONAL AND REINVINDICTIVE MECHANISM OF HUMAN RIGHTS IN THE PRIVATE LIBERTY

The longing for a dignified life has been the engine that has moved millions of people around the world to commit themselves to the defense and promotion of Human Rights when they are violated. The purpose of this research is: 1. Generate theoretical knowledge of justice inherent in the Venezuelan judicial process and the construction of collective justice systems as mechanisms for alternative approach to claiming penitentiary treatment. Developed under a research approach, qualitative with different complementary techniques that allowed to approach and to know the meanings of the inmates, prison system operators and the criminal execution judges. As for the acquisition of knowledge: subjectivity as a form of knowledge as a result of an interaction with others in the framework of a communicative action. The results were interpreted from the perspective of social representations, critical criminology and social reaction with an alternative law approach. Based on the results it can be inferred that it is not possible to resocialize within the humanization plan of prisons under the concept of custodial sentence that prison operators have and that such representations could impede the real change of the penitentiary, So it is necessary to work for a representational and attitudinal change in the prisoners, the justice operators and the execution judges to achieve the humanization of the prison institution. For this reason a collective notion of collective justice emerged from the penitentiary system
