REKONSTRUKSI PERLINDUNGAN HAK-HAK KORBAN TINDAK PIDANA

Victims as the suffred person because of crime, should receive the protection of their rights. Indonesian positive law (Penal Code and Criminal Procedure Code) was originally regulated only compensation to victims. Then, victims' rights later evolved to become more widespread in Law No. 13 of 2006 on the protection of witnesses and victims. However, the protection of victims' rights is not integrated to the criminal justice system. Therefore, the reconstruction of the protection of rights of victims was taken so that all victims can obtain the widest possible access to their rights. Keywords: Victims’ Rights and Laws Protection Korban sebagai pihak yang menderita akibat suatu tindak pidana, perlu mendapat perlindungan hukum terhadap hak-haknya. Hukum positif Indonesia (KUHP dan KUHAP) pada awalnya hanya memberikan hak ganti rugi terhadap korban. Hak-hak korban kemudian berkembang menjadi lebih luas dalam undang-undang nomor 13 tahun 2006 tentang perlindungan saksi dan korban. Namun, perlindungan hak-hak korban dalam undang-undang tersebut tidak terintegrasi dalam jaringan sistem peradilan pidana.
