Conformity of ethically produced goods under the 1980 United Nations convention on contracts for the international sales of goods

This graduate thesis deals with the regulation of ethically produced goods in international commercial law. The CISG is the predominant international sales law and therefore most relevant to examine questions about the application of ethical standards in modern international sales contracts. Also, through this subject, it is visible how is the interpretation of CISG progressive and how it answers to need of the modern economy. This graduate thesis will address the applicability of CISG, how ethical standards even become part of the contract, the uniform concept of the conformity according to Article 35 CISG and the nature of the seller’s obligation to deliver conforming goods. Further, through an analysis of two cases, it will be shown how courts understand the conformity of ethically produced goods. After establishing which goods are to be seen as non-conforming, it will be described possible remedies that the Parties can use.
