EXTRA-CONTRACTUAL CIVIL LIABILITY FOR DAMAGES CAUSED BY AUTONOMOUS ROBOTS: NOTES ABOUT THE REPORT WITH RECOMMENDATIONS TO THE EUROPEAN COMMISSION ON CIVIL LAW RULES ON ROBOTICS (2015/2103(INL)) AND THE (NOT) SUFFICIENCY NATIONAL REGULATORY STRUCTURE AS A PROBLEM SOLUTION

Dissertação de Mestrado em Direito apresentada à Faculdade de DireitoThe development of Artificial Intelligence gives computers the ability to learn and act in an autonomous way, that is, independently from specific instruction by a human being. Given this scenario, this article presents the problem concerning liability imputation of damages caused by the autonomous acts of robots. An approximation to the problem presupposes some technical definitions about robots, AI and the notion of (technological) autonomy and an overview of the context and the approaches in which the recommendations from the Report with Recommendations to the European Commission on Civil Law Rules on Robotics (2015/2103(INL)) are based to circumvent it, which functions as the first parameter in our path. In a second stage, brief remarks are made about the paths taken by civil liability in society of risk and certain particularities pertaining to Portuguese law are alluded. Based on that, an examination is focused on the national regulatory structure that may be applied in the extra-contractual civil liability context, to cases in which robotic activity results in damages to users and/or third parties. In light of a responsibility for autonomous acts of robots, they can be seen as agents, things or equipment. After this analysis, the study is preapred to provide an answer on whether the national regulatory structure is sufficient to fully cover the problem of the autonomous robots, and, in case it is not, to indicate which alternatives would be adequate and likely to be adopted.O desenvolvimento da Inteligência Artificial confere aos computadores a capacidade de aprender e atuar de forma autônoma, isto é, independente de instrução específica de um ser humano. A partir desse cenário, surge o problema da imputação de responsabilidade por danos causados pelos atos autônomos de robôs. Uma aproximação ao problema pressupõe algumas definições técnicas sobre robôs, IA e a noção de autonomia (tecnológica), bem como um sobrevoo pelo contexto e pelas abordagens em que se fundam as recomendações lançadas para contorná-lo pela Resolução com Recomendações à Comissão Europeia sobre Disposições de Direito Civil sobre Robótica (2015/2013(INL)), a funcionar como parâmetro-primeiro no nosso percurso. Numa segunda etapa, tecem-se breves considerações sobre os caminhos tomados pela responsabilidade civil na sociedade de risco e alude-se a certas particularidades atinentes ao direito português. Postas estas bases, empreende-se um exame das vias normativas ordinárias passíveis de aplicação, no âmbito extracontratual, aos casos em que a atividade robótica resulta em danos à esfera de usuários e/ou terceiros. Sob a ótica de uma responsabilidade por atos autônomos de robôs, estes são encarados como agentes, coisas ou equipamentos. Após tal análise, o estudo propiciará a possibilidade de se saber se o quadro normativo ordinário é suficiente para abarcar o problema dos robôs autônomos em sua totalidade, e, caso o não seja, apontar alternativas adequadas e passíveis de serem adotadas.
