Adoption and the Right of the Child to a Family

As such, it should be considered, for all purposes, in the elaboration of legal norms and in the application of them.We can’t forget the transition of the object child to the child subject of rights, which has had significant socio-legal implications.Faced with these same social changes, families modernized themselves, accompanied the new realities and admitted what until recently was unthinkable: homoparental adoption.However, it was considered that not all children had the same opportunity to grow into stable family units and to belong to a family, many of whom were victims of their own childhood.It was understood that when the maintenance of the child in the biological family proved to be so unsustainable or impracticable and affective bonds were severely compromised, adoption would be a viable solution.Adoption is not restricted to traditional legal procedures, with significant progress in speed, requirements and legitimacy.The whole family is charged with the responsibility of satisfying the needs and legitimate expectations of the little ones, providing them both the care and security they desire as far as desirable.However, it is especially important for the adoptive families to begin a new phase, a new chapter in the lives of those children or young people, who mostly try to stay away from the bonds of the past.We believe that every child has the right to a family, be it homosexual or heterosexual, biological or adoptive.O presente estudo versa sobre o instituto da adoção, sempre na ótica da criança e do seu interesse supremo. Como tal, deve ser considerado, para todos os efeitos, na elaboração das normas legais e na aplicação das mesmas.Não podemos deixar cair no esquecimento a transição da criança objeto para a criança sujeito de direitos, o que acarretou significativas implicações sócio-jurídicas. Face a essas mesmas mutações sociais, as famílias modernizaram-se, acompanharam as novas realidades e admitiram o que até há bem pouco tempo era impensável: a adoção homoparental. Porém, foi-se constatando que nem todas as crianças tinham a mesma oportunidade de crescer em unidades familiares estáveis e de pertencer a uma família, sendo até muitas delas vítimas da sua própria infância. Compreendeu-se, dessa forma, que quando a manutenção da criança na família biológica se revelasse de tal modo insustentável ou impraticável e os vínculos afetivos se encontrassem gravemente comprometidos, a adoção surgiria como solução viável. A adoção não se restringe já aos tradicionais trâmites legais, registando significativos progressos ao nível da celeridade, dos requisitos e da legitimidade. Toda a família é encarregue da trabalhosa responsabilidade de satisfazer as necessidades e as legítimas expetativas dos mais pequenos, fornecendo-lhes para tanto o carinho e a segurança que estes almejam na medida do desejável. Porém, cumpre, em especial, às famílias adotivas o início de uma nova fase, de um novo capítulo na vida daquelas crianças ou jovens, que maioritariamente, procuram manter-se longe das amarras do passado.Cremos que toda e qualquer criança tem direito a uma família, seja ela homossexual ou heterossexual, biológica ou adotiva
