International Adoption: The right to family

It is, therefore, no surprise, that our legal framework has long felt the need to regulate the relationships within families.The field of family law is one of the most important, since it is the one that is the most connected to life itself. Family is a sociological reality and withstands the basis of any state, therefore deserving a vast legal protection, that is highly present in legal provisions and other national and international legislations. With that in mind, we can easily understand that one of the main concerns of any and every state is the protection of their children. It is, inclusively, due to this need, that the adoption institute appears. Every child must have the right to family interaction, being a duty of the state to provide the means necessary for that prosecution.Adoption must, at all times, be submitted to the fundamentals of the child’s main interest. This is one of the essential principles of every family interaction, assuming even greater relevance in what comes to the adoption of international children, as this implies an unrooting of the child from its country, in which the different cultures, languages, religions and social setting might hinder the adaption and development of the child within the new family. It is due to this and to the importance that a child’s growth within a biological family has in children themselves that the general knowledge points to the prosecution of subsidizing adoption processes, whether they are. national or international.International adoption appears as a protective measure for children, in face of the high number of orphans, a situation promoted by the great devastation caused by armed conflicts. This practise has become increasingly frequent and the states have felt the need to regulate the transfer of the children in question. It is from this need for legal regulation that the Hague Convetion in 1993 is born.It is from Portugal’s participation in this comºç-vention and from its need to articulate material law with the convention’s regiment that RJPA is born, a unifying regiment that brings relevant changes to national and international adoption processes, in which the right to know one’s own background assumes the biggest legal outbreak.As relações familiares são, indubitavelmente, o alicerce do desenvolvimento físico e intelectual de qualquer criança, sendo, geralmente, através deste “órgão” que são supridas as necessidades materiais e afetivas dos menores. Não é, por isso, de estranhar que o nosso ordenamento jurídico tenha, desde cedo, sentido a necessidade de regulamentar as relações tidas no seio da família.O ramo do direito da família é um dos mais importantes da área do direito, uma vez que é o que mais ligação tem com a própria vida. A família é uma realidade sociológica e constitui a base de qualquer estado, merecendo, deste modo, uma ampla proteção jurídica, que se encontra bem patente nas disposições constitucionais e nas demais legislações nacionais e internacionais. Tendo em conta o suprarreferido, facilmente percebemos que uma das preocupações de todo e qualquer estado será a proteção dos seus menores. É, inclusivamente, devido a esta necessidade que surge o instituto da adoção. Todas as crianças devem ter direito à convivência familiar, devendo os estados proporcionar os meios necessários e exigíveis para a sua persecução.A adoção estará sempre sujeita ao princípio do superior interesse do menor, este é um dos princípios fulcrais de todas as relações familiares, assumindo ainda mais preponderância no âmbito da adoção internacional de menores, por implicar um desenraizamento do menor para com o seu país, onde as diferentes culturas, línguas, religiões e contextos sociais podem dificultar notoriamente o processo de adaptação e desenvolvimento da criança no seu novo seio familiar. É devido aos fatores elencados e à importância que o crescimento das crianças junto das famílias biológicas tem na esfera dos menores que o entendimento geral aponta para persecução da subsidiariedade dos processos adotivos, sejam eles nacionais ou internacionais.A adoção internacional surge como medida protetiva de menores. Este foi o instituto pensado para fazer face ao elevado número de crianças órfãs, situação promovida pela grande devastação dos grandes conflitos armados.A prática tornou-se cada vez mais usual e os estados sentiram necessidade de regular a transferência de menores. É desta necessidade de regulamentação que surge a Convenção de Haia de 1993, em matéria de Adoção Internacional.5Sendo Portugal parte contratante desta convenção e havendo a necessidade de articular o direito material com o regime da convenção, nasce em Portugal o RJPA, regime unificador e que traz substanciais alterações nos processos de adoção nacional e internacional, onde o direito de conhecimento das origens assume o maior rasgo legislativo
