TINJAUAN YURIDIS SOSIOLOGIS KLAIM GANTI RUGI OLEH PEKERJA YANG MENGALAMI KECELAKAAN KERJA TERHADAP PERUSAHAAN (STUDI KASUS PT. KAYAN JAYA TANJUNG SURABAYA)

Work safety relates to machinery, work tools, materials and processing processes, the foundation of the workplace and its environment and the ways of doing the work. Each company is represented by a director, is legally responsible for any workplace accidents that occur in the company. PT. Kayan Jaya Tanjung is a company engaged in woodworking where machinery and equipment in the production process use imported machinery so that special skills are needed, workers are also required to work carefully so that accidents do not occur when working. However, some workers ignore the procedures established by the company and workers do not act safely. The purpose of this study is to find out the extent to which the company is responsible for compensation for workers who experience work accidents and to know the extent of prevention to overcome workplace accidents in the company. The approach method used in the preparation of this legal research uses a sociological juridical approach with qualitative descriptive analysis. Based on the results of research at PT. Kayan Jaya Tanjung Surabaya Unit (2) in terms of three worker status, namely permanent daily workers, daily contracts, and bulk, only the status of permanent daily workers whose compensation claims are in accordance with Law No. 24 of 2011 concerning the Implementation of Social Security Programs in Indonesia, but compensation claims given by companies experience delays in reporting work accident events to BPJS. Prevention efforts to overcome work accidents at PT. Kayan Jaya Tanjung Surabaya Unit (2) has not been optimal and this is related to two approaches namely person approach and system approach.
