Naturaleza e Ineficacia Institucional en la América Española

This chapter is the centerpiece of the work of my doctoral thesis Brief History of HispanicAmerican Constitutional Law. Dissonance with its institutional practice by incardinating in the historiography of public and private institutions of Hispanic America, an aspect in which lies all the problems that have impeded its transition to a modern model of State, with brief exceptions such as the case of Chile, from which our thesis is based since as will be evident, the constitutional architecture of the institutions is manifestly divergent from its operation. We intend to achieve the semantic, syntactic and realistic approach of the term institution, with sufficient entity that transcends its historical condition of simple resulting from the legislative production and cultural development of a community, to demonstrate that the legal system that governs these societies has not represented, neither represents, the collective interest nor materializes the common well-being, and also make patent from that understanding the unviability and ineffectiveness of the regulatory mechanisms of society called Public Institutions. On the other hand, we dispense with any positivist Kelsenian axiom, in which social cohesion can only be achieved coercively in compliance with the mandates contained in the rules, as we will demonstrate that there are stronger glues such as adequate training that encourages social values in a truly democratic scenario and tend to preserve the natural right par excellence, that of Freedom. It is worth noting that the analysis of this chapter is critical as in general is all the work, based on a method based on inductive and verifiable reasoning, without resorting exclusively to premises to arrive at mechanized or modulated conclusions; on the contrary, we try to reach to them through statistical and historical analysis coupled with the observable.Este capítulo es la pieza central del trabajo de mi tesis doctoral Breve historia del derecho constitucional hispanoamericano. Disonancia con su práctica institucional por incardinarse en la historiografía de las instituciones públicas y privadas de la América hispana, aspecto en que radica toda la problemática que ha impedido su transición a un moderno modelo de Estado, con breves excepciones como el caso de Chile, espacio desde el que se sustenta nuestra tesis puesto que como se irá evidenciando, la arquitectura constitucional de las instituciones es manifiestamente divergente de su funcionamiento. Pretendemos lograr la aproximación semántica, sintáctica y realista del vocablo institución, con entidad suficiente que trascienda su condición histórica de simple resultante de la producción legislativa y desarrollo cultural de una comunidad, para demostrar que el sistema legal que rige a estas sociedades no ha representado, ni representa, el interés colectivo ni materializa el bienestar común, y también hacer patente desde esa comprensión la inviabilidad e ineficacia de los mecanismos reguladores de la sociedad denominados instituciones públicas. De otro lado, prescindimos de cualquier axioma positivista kelseniano, en el que la cohesión social solo se puede lograr de manera coercitiva en cumplimiento de los mandatos contenidos en las normas, pues demostraremos que hay pegamentos más fuertes como son los de una adecuada formación que incentive valores sociales en un escenario realmente democrático y tiendan a preservar el derecho natural por excelencia, el de la libertad. Es de advertir que el análisis de este capítulo es crítico como en general lo es todo el trabajo, basado en un método ceñido a razonamientos inductivos y verificables, sin recurrir exclusivamente a premisas para llegar a conclusiones mecanizadas o moduladas, por el contrario, intentamos llegar a ellas a través del análisis estadístico e histórico aunado a lo observable.&nbsp
