La omisión legislativa como hecho generador de la responsabilidad patrimonial del Estado

Corresponde esta forma de responsabilidad a una responsabilidad objetiva, cuyo fundamento se encuentra en el principio de igualdad, aplicándosele los fundamentos de la responsabilidad del Estado por acción a partir de la noción de falta del servicio. En este marco de desarrollo jurídico, en la presente disertación partiendo del estudio del Estado Social de Derecho como sustento de la responsabilidad del Estado, se analizará el desarrollo que ha tenido en reconocimiento de la responsabilidad del Estado-Legislador en el derecho comparado y en el derecho interno, para luego establecer el tratamiento dado a la responsabilidad del Estado por omisión legislativa. Se demostrará igualmente como hoy todo tipo de responsabilidad imputado al Estado debe ser reparado con fundamento en la teoría del daño antijurídico, en el que se debe responder por los daños que ocasione a los administrados por desconocimiento al principio de la igualdad de las cargas públicas. Posteriormente, se establecerá el título de imputación jurídica que permite hacer efectiva la reparación de los daños cuando es declarada la responsabilidad del Estado por omisión legislativa
