Derecho, subjetividad y espacialidad

These article intents to perform a conceptual and analytical effort the suggested relationship between law, space and subjectivity, whit the intention of contributing to the debate on social and political significance of contemporary law, but embedded within the space variables and the production of the subject. In fact this work is a reflection that wants to build elements to understand the nature of the crisis right in peripheral societies. To that end, intends to build some elements of analysis to understand the nature of law and its crisis in the contemporary social organization. Here we see that the lawfulness of social relations not only committed to subject as an essential part of the legal system as a whole but, simultaneously, the law has the ability to form and establish both formal characteristics of these materials. In other words, law is an active component in the formation of subjectivity. In this process, the law participates through the organization of space and socially constructed space, in the internalization and control of the social nature of the subjects. However, it warms that on this homework that aims to accomplish the law are many social coping strategies that disrupt or temporarily suspending its purposes. The reappropriation of the subjects in the double stage production of its own subjectivity and reorganization of social space within new and emerging affirm their subjective production, may lead to social areas of production of new social relations.El presente artículo pretende realizar un esfuerzo analítico y conceptual de la relación sugerida entre Derecho, espacio y subjetividad, con el propósito de contribuir al debate sobre la significación social y política del Derecho contemporáneo, pero incrustado dentro de las variables del espacio y la producción del sujeto. En realidad este trabajo constituye una reflexión que quiere construir elementos para entender la naturaleza de la crisis del derecho en las sociedades periféricas. Para tales efectos, pretende construir algunos elementos de análisis para entender la naturaleza de éste dentro de la organización social desde una perspectiva crítica. Aquí se advierte que la juridización de las relaciones sociales no solo comprometen a los sujetos como parte esencial del ordenamiento sino, que simultáneamente, el derecho tiene la capacidad de formar y determinar las características tanto formales como materiales de éstos. Es decir, el derecho es un componente activo en la formación de la subjetividad. En este proceso, el derecho participa a través de la organización del espacio o espacio socialmente construido que internaliza, fija y controla espacios muy importantes de la naturaleza de los sujetos. A pesar de ello, se advierte que en esta tarea que pretende cumplir el derecho existen múltiples estrategias de resistencia social que perturban o suspenden provisionalmente sus propósitos. La reapropiación de los sujetos en el doble escenario de producción de su propia subjetividad y de reorganización del espacio social dentro del cual afirman su nueva y emergente producción subjetiva puede dar lugar a territorios sociales de producción de nuevas relaciones sociales
