La carrera administrativa desde la Jurisprudencia Constitucional

As a part of the research project called the Administrative Career in Colombia, it was identified the necessity of doing a state of art in order to know the current situation of the merit system in the Colombian common duty. This objective consists of several components. First of all, it takes into account the different actors who are committed to the processes of adopting, regulating or interpreting the respective normative frames. A second element links those actors with the analysis of the conception and the scope they have in terms of this technical system for managing the human talent. A third aspect has to do with the public workers’ vision and the citizens’ expectations regarding the common duty. For that reason, this paper is a partial product of the research first phase. Throughout this part, it can be identified the vision of the Constitutional Court, as an actor that has played an essential role in creating the merit system in Colombia. In fact, through the most recent jurisprudence, it has contributed to elucidate controversial aspects to direct the career system in the Colombian public administration.Dentro del proyecto de investigación La carrera administrativa en Colombia, se contempló la necesidad de elaborar un estado del arte que permitiera conocer la situación actual del sistema de mérito en la función pública colombiana. De este objetivo se desprenden diferentes componentes: En primera instancia, vincula a los diferentes actores que se encuentran comprometidos en los procesos de adopción, reglamentación o interpretación de los respectivos marcos normativos. Un segundo elemento compromete a tales actores en cuanto al análisis de la concepción y el alcance que tienen sobre este sistema técnico de gestión del talento humano. Un tercer aspecto tiene que ver con la visión de los servidores públicos y las expectativas de los ciudadanos sobre la función pública. Por ello este ensayo es un producto parcial de la primera fase de la investigación, a través del cual se recoge la visión de la Corte Constitucional, como actor que ha tenido un papel protagónico en la construcción del sistema de mérito en Colombia. De hecho, por medio de la jurisprudencia más reciente, ha contribuido a dilucidar aspectos controversiales para orientar el sistema de carrera en la administración pública colombiana
