La fiscalización gubernamental sobre las sociedades comerciales

Through this research I want to offer legal and business community Colombian evidence when assessing the existence of the Superintendency of Corporations in Colombia, taking as reference the concept of “social interest”. This paper begins by reviewing the historical background and the Superintendency of Corporations, then becomes a study of the legal nature and functions assigned to that body, then we review the different conceptions of the notion of “social interest. Here, at the same time I will explain explain and analyze traditional and modern theories of the concept of “social interest”, and I intend to prove my hypothesis which is that for the current social, economic, political and cultural life of our country, it is absolutely necessary and desirable the existence of an entity such as the Superintendency of Corporations.A través del presente trabajo de investigación quiero ofrecer a la comunidad jurídico-empresarial colombiana elementos de juicio a la hora de valorar la existencia de la Superintendencia de Sociedades en Colombia, tomando como punto de referencia el concepto de “interés social”. En este escrito se comienza por revisar los antecedentes y la evolución histórica de la Superintendencia de Sociedades, luego se hace un estudio de la naturaleza jurídica y de las funciones asignadas a la mencionada entidad, posteriormente se revisan las distintas concepciones de la noción de “interés social”. Aquí, a la vez que se van a explicar y a analizar las teorías tradicionales y modernas del concepto de “interés social”, pretendo demostrar mi hipótesis según la cual para la actual realidad social, económica, política y cultural de nuestro país se hace absolutamente necesaria y por demás conveniente la existencia de una entidad como la Superintendencia de Sociedades
