El Constitucionalismo Andino y su desarrollo en las Constituciones de Bolivia, Ecuador, Perú, Colombia y Venezuela

South American Constitutional law has been, since its inception, influenced by European law. However, the rise of indigenous social movements has started a reflection on the foundations of the particular law or the indigenous ancestral law. These concepts have also slowly transformed the Constitutional concept of western court via the introduction of concepts that follows the legal pluralism and historical recovery of aboriginal cultures. One of the pillars of the new Constitutional movement, or the Andean Constitutionalism, is the inclusion and protection of the indigenous law traditions. Moreover, one of the true advances of the Andean Constitutionalism has been the introduction of ancestral Inca culture principles such as de right to a “good living” and the origins, fundamentals and sources of their legal system. This document presents a comparative study of the countries that have introduced these ideas in their Constitutions by presenting the progress achieved in each case, ideas that have changed the local perspective on Constitutional law and society goals.El Derecho constitucional suramericano ha estado, desde sus inicios, enmarcado por fuentes europeas. Sin embargo, con el surgimiento de los movimientos sociales indígenas, se han iniciado procesos de reflexión sobre las fuentes del derecho propio o derecho ancestral indígena y se cambiado paulatinamente el concepto constitucional de corte occidental introduciendo principios basados en el pluralismo jurídico y la recuperación histórica de las culturas autóctonas. Uno de los pilares del nuevo movimiento constitucionalista, llamado Constitucionalismo Andino, es la inclusión y protección de las culturas jurídicas indígenas, además uno de sus avances ha surgido con la inclusión de principios ancestrales de la cultura incaica como el derecho al “buen vivir” y los orígenes, fundamentos y fuentes de este sistema jurídico. El presente artículo efectúa un estudio comparativo de los países que han desarrollado estos principios mostrando los avances en cada uno de los casos, cambiado la perspectiva del derecho constitucional y la visión de las sociedades
