The article deals with the limitations and scope of the 1968 Treaty on Nuclear Non-Proliferation. The latter is a structural agreement reflecting therefore the political equilibrium at the time of its adoption. Nowadays it presents several limitations because the political dimension it changed in a world not anymore bipolar. Since there are not chances to adopt a treaty on nuclear disarmament, the only choice is to root via interpretation of the 1968 Treaty or via other international rules the prohibition of utilization of nuclear weapons
