The intensification of social deviation.

This article consists of four parts: 1. The intensification of social deviation as the phenomenon of transition form a totalitarian regime to democratic. 2. The present context of the evoliution of community in Lithuania. 3. The social collage and social deviation. 4. The challenge of social deviation to the rule of law. The article analyses the problem of the intensification of social deviation. The first part of the article reveals the relation of the concept of social deviation to the concept of law and political regime. The concept of social deviation in a democratic state must be based on the notion of civil law. Therefore, social deviation must be analysed on the levels of the individual, the institution and the social system. The temporary intensification of social deviation marks the state's transition from the totalitarian rule to democracy. The second part of the article discusses the present context of the evolution of the community in Lithuania that threatens the safety of the society and hampers the formation of the civic society. The third part of the article presents the systemized features of the reconstruction of the state and its consolidation. A number of these distinctive features characterize certain cases of social deviation. Social collage is considered to be the interaction of the three distant and even contradicting social phenomena, such as the soviet mentality, privatisation and market economy, in which these phenomena are deformed. The fourth part of the article analyses the danger of the legalisation of the activities of unconstitutional nature, which may result in the devaluation of law.Straipsnyje nagrinėjama socialinės deviacijos (nukrypimų nuo bendruomeniškų visuomenės normų ir interesų) intensyvėjimo problema, kuri itin išryškėjo Lietuvai atkūrus savo valstybingumą. Lietuvos valstybingumo atkūrimas ir jo įtvirtinimas grindžiamas ryžtingu ir nuosekliu perėjimu iš totalitarinio politinio režimo į demokratinį. Vis dėlto šis perėjimas yra skausmingas procesas, nes visuomenei, ilgą laikotarpį gyvenusiai totalitarizmo sąlygomis, tenka iš naujo įsisąmoninti fundamentalias vertybes – laisvę ir socialumą. Tai negali įvykti staiga, nes sovietinių socialinių normų atmetimas susijęs ir su naujų elgesio modelių kūrimo būtinybe, ir su visuomenės pastangomis įveikti sociokultūrinę krizę.Tarp jų egzistuoja akivaizdus ryšys: sėkminga krizės įveika skatina formavimąsi tokių elgesio modelių, kurie atitinka demokratinį politinį režimą ir jį įtvirtina, bei atvirkščiai. Bet gali būti ir, deja, yra kitaip. Sociokultūrinės krizės įveika susidūrė su fundamentalia visuomenės problema – neišvystyta jos socialine (bendruomeniška) sąmone. Tai laidavo suabsoliutintos asmens laisvės sampratos formavimąsi ir įgyvendinimą agresyviomis formomis, kuriomis įtvirtinama prieš visuomenės bendruomeniškumą (pilietinę visuomenę) nukreiptas jos sociokultūrinės raidos kontekstas ir kartu sudaromos palankios sąlygos neteisinės prigimties veiksenai įsitvirtinti visuomenėje kaip įstatymiškai teisėtai. Bet reikia prisiminti, kad pati teisė suprantama plačiau už įstatymą: teisė yra socialinis interesas, paverstas visuotinai privalomo elgesio taisykle, skirta norminti žmonių elgesį, derinti priešingus interesus (A.
