Constitutional Court of the Republic of Lithuania and impeachment of higher officers of the state: some the most important problems

The article discusses the role of the Constitutional Court in examining constitutional justice cases regarding the impeachment of high state officials. The author analyses the institute of impeachment established in the Constitution of the Republic of Lithuania from the perspective of the interaction between law and politics and the relation between the facts and the law in constitutional justice cases. The jurisprudence of the Constitutional Court of the Republic of Lithuania indicates the Court’s aim to strengthen the legal aspect in impeachment, which means that only the Constitutional Court has the power to make a judgement regarding the constitutionality of the particular actions of an impeached person, that the Constitutional Court’s ruling that a person violated the Constitution is final, and that the fact of a gross violation recorded in the said ruling may not be changed, denied or questioned. The particularity of this type of constitutional justice cases is the Constitutional Court’s duty to investigate the actual acts of high state officials and present their constitutional evaluation. Thus, in this type of cases there is the problem of the relation between the fact and legal investigation.
