This paper discusses selected legal aspects of nanotechnology in the production of food and materials intended to come in contact with food, and analyses statutory regulations on potential risk assessment in the event of using nanotechnology in new foods and materials for contact with food, and acts regulating chemical substances and their mixtures. It seems that Regulation No 1169/2011 which contains a detailed definition of nanomaterials is the most suited for reference when the above issues are discussed. From the point of view of the obligation of informing customers of the presence of nanoparticles in food, the solutions of the Regulation are satisfactory.
