The aim of the paper is to establish the scope of the EU food hygiene and safety regulations that bind agricultural producers and the extent to which an individual member state may derogate from them. The European Union law does not provide for any hygiene requirements with regard to direct agricultural products supplies (primary production), leaving relevant food safety and no-risk for public health legislation in the hands of member states. Primary production is subject to general and less rigorous requirements set out in regulation 852/2004, whereas to secondary production the more detailed and more restrictive provisions of appendix II of regulation 852/2004 and the provisions of regulation 853/2004 concerning animal products ap...
