TANGGUNG JAWAB PT. KERETA API INDONESIA (PERSERO) TERHADAP KERUSAKAN BARANG AKIBAT KECELAKAAN KERETA API

The title of this research is responsibility of PT. Kereta Api Indonesia (Persero) to damaged goods by train accidents. PT. Kereta Api Indonesia (Persero) as a railway transportation service provider. Railway may carries goods or passengers. In the case of carriage goods or passengers has some risks, one of them is damaged goods. The damaged goods in this case is by train accidents. The research focused on two purposes, the first is to know the responsibility of PT. Kereta Api Indonesia (Persero) to damaged goods by train accidents. Subsection of Law Number 23 year 2007 are discussed in relation to the responsibility for the damaged goods which is related to the principle of transport responsibility in the transport law. The second is to know the legal efforts that will through by consumers who has loss used the Law number 8 year 1999 on Consumer Protection in terms of legal effort that will takes. The type of legal research used in this research was normative juridical research. In relation to the normative legal research the researcher used statute approach
