EKSISTENSI UNDANG-UNDANG HUKUM PIDANA DALAM PENANGGULANGAN KASUS PENJUALAN OBAT PENGGUGUR KANDUNGAN MELALUI MEDIA SOSIAL

The development of information technology in the era of globalization led to the emergence of new crimes that exist in public life. The Internet is one of the processes of globalization that allows one person to connect with other people. However, the Internet, especially social media can be used as a tool to commit crimes, one of which is to sell abortion drug through social media such as instagram, Facebook, Twitter. In Indonesia the suspect of abortion drug through social media, can be charged to criminal sanctions through KUHP (criminal code) and the Law outside of codification especially law on health and information technology legislation. The implementation of this legal dualism can have negative impacts such as, lowering people's trust and ignorance of law enforcement officers and also the emergence of negative judgments on legal institutions. Furthermore, the ambiguous legal sources themselves can increase the likelihood of awareness among the community or create social jealousy. This thesis uses normative legal research method that is focused on positive legal norms in the form of legislation. The sale of obstetric drugs through social media is important to be specifically regulated in a legislation provision of obstetric drugs in order for the sanctions imposed not to result in any criminal disparity
