PENERAPAN PENGATURAN HAK LINTAS LAUT BAGI KAPAL ASING DI PELABUHAN KELAS II AMAMAPARE (PORTSITE) PT FREEPORT MENURUT KONVENSI HUKUM LAUT PBB 1982

United Nations Conventions On The Law Of The Sea 1982 has regulated some rights of the sea passage, one of the which is rights of transit passage. In Indonesia, many ships from other countries pass by not using rights of transit passage in the territorial sea but using the right of innocent passage. For example, at Amamapare Port Site, the ship of PT Freeport Indonesia was stopped for long periods at Arafuru Sea to did operational activities like loading and unloading the shipload. The methods in this thesis used normative research. The data was collected through the use of library research, regulations, and legal opinion. The conclusion from this thesis is the application of rights of sea passage at Amamapare Port Site does not use rights of sea passage that was regulated in United Nation Conventions On The Law The Sea 1982. Activities at Amamapare Portside was use circular letter of the transportation ministry of directorate general of the sea transportation UM.003/28/06/UPP.Amp-14 and regulation of head of Amamapare Portsite Number: OT.101/28/02/UPP.Amp-2014
