PELAKSANAAN PENGADAAN TANAH UNTUK PEMBANGUNAN UNIT SEKOLAH BARU MILIK PEMERINTAH DI KABUPATEN SEKADAU PROVINSI KALIMANTAN BARAT

The improvements on infrastructure cannot be separated from the process of land acquisition. The land acquisition process is done by giving compensations to the right holders of the lands. In the district of Sekadau, Province of West Borneo, Indonesia, the process of land acquisition was done less than 5 hectares by the Sekadau’s Department of Education and Culture as the government agency that needed the lands. The compensations in form of replacement money or lands were given to the right holders of the lands according to legal procedures of the law. There are some problems happened during the land acquisition process as the impact of the lack of knowledge of the people in Sekadau upon the procedures of land acquisition process. They also did not understand to the activities of compensations giving. The people thought that the ongoing process was an illegal transaction of buying and selling lands, however the process of transaction was actually related to the public infrastructure, which was an implementation of a plan to construct a public school on the lands, because in some rural areas there need to have education facilities such as public school in each area. There was an internal factor done by the government agency (Department of Education and Culture), which influenced the efficiency of compensation processes and caused some confusions on the amount of money that should be paid as the compensations to the right holders in each village, according to the agreements that has been made by the government agency and the right holders. This problem is a fact that the people in district of Sekadau still need to be educated, especially about the land acquisition procedures. National Land Agency as the agency that handles the land matters have to do some efforts to educate the people about the land acquisition procedures by giving them a continuance concealing upon the land acquisition matters and procedures
