Tinjauan Hukum Pelaksanaan Penjualan Konsinyasi (Titip Jual) antara Distibutor Outlet (Distro) dengan Supplier (Studi Kasus Distro HOOFD AWSM)

This study aims to determine : a) What is the validity of the consignment agreement between distributions and suppliers; b) What is the form of consignment sales (selling points) between distributions and suppliers; c) How to settle disputes over the implementation of consignment sales (selling points) between distributions and suppliers. The problem approach used is juridical-empirical, is an approach to the law as a norm in the form of the Civil Code against the reality regarding the implementation of consignment sales between suppliers (Case Study of DistroHoofd Awsm). The type of research used is descriptive, which is a study that provides a real picture of the implementation of consignment sales between suppliers (Case Study of DistroHoofd Awsm). Research result; a) The contract of cooperation between Distro Hoofd Awsm and the supplier uses the terms of the sales agreement but in practice more familiar with the term Consignment cooperation contract, which resembles a distribution, agency, custody and sale transaction contract modified and compared in a freedom of contract is a written agreement of the interaction business;b) The implementation of consignment cooperation carried out by Droro Hoofd Awsm with suppliers is in accordance with the applicable law in Indonesia, namely the Civil Code. Among them are regarding the legal requirements of the agreement in Article 1320 of the Civil Code regarding skills, agreement between the distro dansupplier, objects of goods in the form of clothes, pants, bags and caps and causa that are lawful that the agreements are carried out transparently and do not violate the principles of agreements or other regulations; c) Distros and suppliers who make defaults can be imposed sanctions as stated in Article 1276 of the Civil Code, namely in the form of paying losses, canceling agreements, transferring risks and paying cases if they are brought to trial
