Polygamy is choice for husband who can or need. But the implementation of polygamy in the society much of them get divorce and the last polygamy it would be attention of society and law. Indonesia as the state of law have manage The procedure of polygamy in the law of marriage gives some requirements for husband who want to do polygamy as follow: a husband is obligated to take permission from his wife, the functionary of his work (for government official) and from the court as the law phase for getting the permission. Never the less, the court will not give permission of doing polygamy except by this conditions the wife is unable to do her obligation to her husband, she has incurable disease and she is unable to pregnant it is different with polygamy according to Islamic jurisprudence polygamy has been managed comprehensively from any sides and ways to be done. This research aimed to know law base used in polygamy and clear it between law of marriage and Islamic jurisprudence. The writer used normative and descriptive method for writing this thesis and focuses on researching why Indonesian law of marriage make the procedure is difficult and how the Islamic jurisprudence view that being made as source of firm belief the result of analysis in polygamy matter according to the law of marriage in Indonesia have aimed for managing practice of marriage and giving rights for wife’s and sons. The Islamic jurisprudence view about law of marriage made the procedure very difficult for husband by long procedure, guarantee right each member of the family and give them right of law
