Tinjauan Hukum Pidana terhadap Masalah Euthanasia

Euthanasia is an act of ending the life of a person who is suffering (sick) that is very heavy and medically incurable. This study aims to determine the handling of cases of euthanasia that occur in the community and to know the euthanasia arrangements in the Indonesian Penal Code and to know the euthanasia arrangements in the National Criminal Code Draft Law. The research method used a descriptive normative juridical approach. The data source consists of secondary data, namely primary, secondary and secondary law sources. Methods of data collection with literature study and then the data were analyzed qualitatively. The results showed that the handling of cases of euthanasia that occurred in Indonesia can not be done specifically, but it is set in the Indonesian Criminal Code states that whoever intentionally or not planned or let until the life of a person died, it will get punishment of punishment imprisonment contained in the Chapter XIX Criminal Code Articles 338 to Article 350 concerning crimes against the souls of persons. Whereas in the Draft of the National Criminal Code states that any person who robs the life of another person at the request of another person in the case of another person is not aware of being criminally charged
