Violence against women: a question of gender - Montes Claros-1985-1994

The purpose of this study and discuss violence against women, particularly the crimes committees against them in Montes Claros, in the period 1985 to 1994. Our discussion has reference to case law analyzing historically the Brazilian Civil and Criminal Codes, and found support in studies of gender, a category thal from the 1990, it became essential for historical analysis, especially from the feminist perspective, a since the question has a cultural given in our society and about what being a woman and man, allowing us to new visions and interpretations about the stigma in the social relations of this subject. Our Corpus is documentary in the analysis of criminal cases related to crimes of murder, injury and rape, committed against women and perpetrated by men, by the mere fort of being considered culturally superior and holders of power and women, therefore, inferior and submissive. We emphasive that the speeches of delegates documentation of police, judges, defense lawyers, witnesses and victims defendants and the judicial system is positioned in front of such crimes. To that end, our analysis also contributes to the oral history with reports of life of victms, offenders and the police men. Realizing the different possibilities of analysis of our documentary corpus, we chose to privilege the analysis of possible changes and remain with regard to violence against women, such as social order and not as a crime but as a tolerable inconvenience , something that must be borne by the woman not to destabilize the social order, family and marriage.Coordenação de Aperfeiçoamento de Pessoal de Nível SuperiorMestre em HistóriaA proposta deste trabalho é discutir a violência contra mulheres e, em particular, os crimes cometidos contra as mesmas em Montes Claros, no período compreendido entre 1985 a 1994. Nossa discussão teve como referencial a jurisprudência brasileira, analisando historicamente os Códigos Civis e Penais, e encontrou respaldo nos Estudos de Gênero, uma categoria que, a partir da década de 1990, se tornou de fundamental importância para análises históricas, especialmente sob a perspectiva feminista, uma vez que permitiu questionar a ordem cultural dada em nossa sociedade acerca do que é ser mulher e ser homem, permitindo-nos novos olhares e interpretações sobre o estigma presente nas relações sociais desses sujeitos. Nosso corpus documental constituise de processos criminais relacionados aos crimes de Homicídio, Lesão Corporal e Estupro, cometidos contra mulheres e perpetrados pelos homens, pelo simples fato de estes serem culturalmente considerados superiores e detentores de poder e as mulheres, conseqüentemente, inferiores e submissas. Enfatizamos entre tantas fontes os discursos das delegadas de polícia, juízes, advogados de defesa, testemunhas, vítimas e réus, e como o Sistema Judiciário se posiciona diante de tais crimes. Nesse mesmo sentido, contribui também para nossas análises a História Oral com relatos de vida de mulheres agredidas, homens agressores e autoridades policiais. Percebendo as diversas possibilidades de análises do nosso corpus documental, optamos por privilegiar a análise de possíveis mudanças e/ou permanências no que tange à violência contra as mulheres, já que essa é vista socialmente não como um crime, mas como uma inconveniência tolerável , algo que deve ser suportado pela mulher para não desestabilizar a ordem social, a família e o casamento
