Socio-affective parenting

The purpose of this paper is to discuss the legal effects of socio-affective parenting, especially in the contemporary idea of family. Through the deductive method, this research will analyze the changes in the concept of family occurred in the last decades, that shook the consolidated structure of Family Law, which was built over the sacred bond of marriage and patrimonialism, in order to discuss the incidence of socio-affective parenting as a structural element of the current conception of family. Through the argumentative method, it will be analyzed the existing divergences involving the legal effects produced by this institute, based on the great amount of sentences reformed in the higher instances and the minority vows in the judgments made by the Courts. At the end, it will be provided an overview of how the legal effects of the socio-affective parenting are being applied and what is the best solution to the existing conflicts.Trabalho de Conclusão de Curso (Graduação)O objetivo do presente trabalho é discorrer sobre os efeitos jurídicos da parentalidade socioafetiva, notadamente no que diz respeito à compreensão contemporânea e atual da ideia de família. Por meio do método dedutivo, iniciar-se-á a pesquisa analisando-se as mudanças no conceito de família ocorridas nas últimas décadas, as quais abalaram a consolidada estrutura do Direito de Família então edificada em cima do sagrado vínculo do matrimônio e do patrimonialismo, para ao fim se discutir sobre a incidência da parentalidade socioafetiva enquanto elemento estrutural da atual concepção de família. E por meio do método argumentativo, analisar-se-ão as divergências quanto aos efeitos jurídicos produzidos por esse instituto, o que fica evidente quando se observa a grande quantidade de sentenças reformadas nas instâncias superiores e de votos vencidos nos julgamentos feitos pelos Tribunais. Ao fim, buscar-se-á formar um panorama de como os efeitos jurídicos da parentalidade socioafetiva estão sendo aplicados e qual a melhor solução para os conflitos existentes
