The impact of the Disability Statute on consumer contracts concluded by people with mental deficit

The impact of the changes promoted by the Disabled Person Statute on disability theory, as a result of the protection-emancipatory system inaugurated by The United Nations Convention on the Rights of Persons with Disabilities, signed in New York in 2007, prompted doctrinal question whether the emancipation granted to persons with mental or psychic deficits has taken place adequately. The general objective of the research is the analysis of this impact in the celebration of consumer contracts, mainly with respect to the patrimonial effects and the guarantee of the dignity of disabled people. In this way, it is proposed to answer the following question: the Statute, by promoting this change in the theory of disabilities, no longer considering as absolutely incapable the person with functional or mental deficiency, focused on insufficient protection since it allowed that person to enter into consumer contracts freely? As a hypothesis, it is pointed out that the provisions of the Statute in emancipating the person with mental deficit may have set up insufficient protection, since it did not verify the particularities of each person by granting all the full capacity, placing the person's mental disability at risk by allowing it to enter into consumer contracts without assistance or support from other peoples, not yet observing the human dignity of the person with mental deficit. The theoretical reference of research is the empowerment of historically excluded people, a role that is developed both by international humanitarian conventions and internally by civil constitutional law, as well as by the recognition of the vulnerable, by studying the new private law and protecting the vulnerable. The research was developed in the form of theoretical research, based on the collection and revision of articles, legal works and other bibliographical materials related to the presented theme, using the analytical-dogmatic and critical-normative methods, being the methodological orientation developed through the argumentative method, once fundamental rights have been worked, whose content reflects strongly value character. It was concluded that although the new legislation has focused on insufficient protection, failing to observe effective safeguards to prevent abuses, it has been necessary to ensure the dignity of the disabled person. In this way, the solution of any conflict of norms should be based on the idea of complementarity of norms, by the theory of the dialogue of sources, aiming to guarantee the interpretation more favorable to the person with disability and guaranteeing the same the right to the free development of the personality.Dissertação (Mestrado)O impacto das alterações promovidas pelo Estatuto da Pessoa com Deficiência na teoria das incapacidades, em decorrência do sistema protetivo-emancipatório inaugurado pela Convenção Internacional sobre os Direitos das Pessoas com Deficiência e seu Protocolo Facultativo, assinados em Nova York em 2007, promoveu inquietação doutrinária ao ponto de se questionar se a emancipação concedida às pessoas com deficiência psíquica ou mental se deu de forma adequada. O objetivo geral da pesquisa é a análise desse impacto na celebração de contratos de consumo, mormente no que diz respeito aos efeitos patrimoniais e à garantia da dignidade das referidas pessoas. Deste modo, propõe-se responder a seguinte indagação: o Estatuto, ao promover essa alteração na teoria das incapacidades, não mais considerando como absolutamente incapaz a pessoa com déficit funcional psíquico ou mental, incidiu em proteção insuficiente com relação a esse sujeito, deixando-o desprotegido para celebrar contratos de consumo? Como hipótese, aventa-se que as disposições do Estatuto ao emancipar a pessoa com deficiência psíquica ou mental pode ter configurado proteção insuficiente, uma vez que não verificou as particularidades de cada pessoa ao conceder a todos a capacidade plena, colocando o patrimônio da pessoa com deficiência mental em risco ao permitir que a mesma celebre contratos de consumo sem assistência ou auxílio de terceiros, não observando, ainda, a dignidade humana da pessoa com déficit mental. O referencial teórico da pesquisa é o empoderamento das pessoas historicamente excluídas, papel esse desenvolvido tanto pelas convenções internacionais humanitárias, como internamente pelo direito civil constitucional, como pelo reconhecimento dos vulneráveis, com o estudo do novo direito privado e a proteção dos vulneráveis. A pesquisa foi desenvolvida na forma de pesquisa teórica, baseado na coleta e revisão de artigos, obras jurídicas e demais materiais bibliográficos relacionados à temática apresentada, valendo-se dos métodos analítico-dogmático e crítico-normativo, sendo a orientação metodológica desenvolvida por meio do método argumentativo (método de abordagem), uma vez que foram trabalhados direitos fundamentais, cujo conteúdo reflete caráter fortemente valorativo. Concluiu-se que embora a nova legislação tenha incidido em proteção insuficiente, por não observar as salvaguardas efetivas para prevenir abusos, a mesma foi necessária para garantir a dignidade da pessoa com deficiência. Deste modo, a solução de eventual conflito de normas deve ser pautada na ideia de complementariedade das normas, pela teoria do diálogo de fontes, objetivando garantir a interpretação mais favorável à pessoa com deficiência e garantindo a mesma o direito ao livre desenvolvimento da personalidade
