In this study I analyze current statutory and case law relating to home education and assertions of constitutional rights by those engaging in home education throughout the United States. I conclude that both the United States Supreme Court, and the lower courts following its dictates, have failed adequately to articulate a consistent and persuasive constitutional framework regarding home education. Through detailed analysis of state and federal law, and interweaving a philosophical argument forwarding a pragmatic theory of constitutional rights, I point out the practical futility of asserting "absolute" rights in this setting.
