REFORMA AGRARIA INDONESIA DI ERA JOKO WIDODOMUHAMMAD JUSUF KALLA TAHUN 2015-2019 (TELAAH YURIDIS ATAS UU NO 5 TAHUN 1960 TENTANG PERATURAN DASAR POKOK-POKOK AGRARIA)

Since the inauguration of Joko Widodo and Jusuf Kalla as President and Vice President of the Republic of Indonesia, the discourse on implementing agrarian reform in Indonesia has been intensified again. Through the National Medium Term Development Plan (RPJMN) for 2015-2019, in the Chapter of Land, it is stated that the Government will implement Agrarian Reform with Asset Legislation and Asset Redistribution schemes. In its implementation, this program creates the pros and cons because many perceptions from some parties mention that the program agenda is not in line with the principles of agrarian reform as stated in Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles. The problem in this research was elaborated by using library research methods (library research) and then it is a normative legal research. Normative legal research is carried out by examining library material both primary and secondary data. This study uses statute approach by presenting the material in a systematic-comprehensive discussion through various sources of literature that refers to legal norms relating to agrarian reform in Indonesia. Furthermore, it is used as a basis for precise analysis with the aim of obtaining results that can be accounted for. After being analyzed in depth, Indonesia's agrarian reform program in 2015-2019 actually has a loss gap that can be proven by juridical defects, for example the finding that the asset legislation program is an order from Government Regulation No. 24 of 1997 concerning Land Registration, the redistribution of assets with the scheme of Social Forestry is an order of Law No. 18 of 2013 concerning Forestry. On the other hand, the aspiration of granting access to equal land ownership as response to the high inequality of land ownership -caused by many agrarian conflicts- through agrarian reform is not seriously carried out based on Law No. 56 Prp of 1960 concerning the Determination of Agricultural Land Area and the absence of derivative regulation related to agrarian conflict resolution
