ANALISIS TERHADAP PELANGGARAN PENGENDARA YANG MENGGANGGU FUNGSI JALAN TOL DITINJAU MENURUT PASAL 63 AYAT (I) UU NOMER 38 TAHUN 2004 (STUDI DI PT CITRA MARGATAMA SURABAYA PENGELOLAH TOL WARU-JUANDA)

Traffic problems are a form of violation that occurs not because of the ignorance of the inspector regarding various regulations and traffic signs, but the lack of awareness of motorists towards traffic regulations. The creation of order and smoothness on the toll road is also one of the objectives of the law. Law enforcers must always avoid coercion and violence as much as possible. Every law enforcer on the highway must reject all gifts that tend to affect the nature of his decision. According to the data, there are several cases of traffic violations that occur in accordance with Article 63 paragraph (I) of Law number 38 of 2004. Law (Law) is made to maintain order which leads to justice, certainty and usefulness. Including Law No. 38 of 2004 is certainly made in order to achieve the objectives of the law. So research is conducted to find out the factors that cause motorist violations that interfere with the function of toll roads and the efforts made by law enforcement agencies in overcoming motorist violations that disrupt the function of toll roads. The research was conducted at PT. Citra Margatama Surabaya and using sociological juridical using the interview method. The results of this study show that the mindset of people who are practically driving on the highway has given birth to an instant community both when driving and outside driving, because human error with deliberate reasons and lack of knowledge of traffic laws on the toll road. So that cooperation between police officers and related parties is carried out to overcome violations that occur with preventive and repressive efforts. For that reason, the police as law enforcement officers should increase the procurement of toll road patrols rather more self-discipline traffic. The police should improve socialization and counseling services to the public on traffic procedures, especially on toll roads
