Periodismo jurídico oitocentista: a Revista do IAB na cultura das revistas jurídicas brasileiras do século XIX (1843-1888)

Direito.Vehicle of legal thought's difusion and circulation, testing laboratory to intelectual jurists and privileged space for cientific comunication: the law review is seen in this paper, in its nineteenth century cradle, as a research object considered in itself, and not only as a certainly privileged source to think the nineteenth century juridical culture. Using the instruments of the printed matter cultural history, the focus of the investigation is directed to the first Brazilian law review which expanded both ambition and aim of its editorial line, perpasing the three years existence mark and focusing not only in releasing judgements and acts of justice - as the legal journals before it - but also in being a data repository for douctrinal texts of larger aim: the Brazilian Bar Association Institute's Review. Even considering it was firstable conceived as a divulgation vehicle of this Institute, it could no longer be considered as only an informative journal of local difusion which aim was to publicize Courts'jurisprudential production. This is said because in its content it brought doctrinal debates involving jurists of outstanding performance in the political scene of the Brazilian Empire. Understanding its historical relevance as a rupture and innovation element within an embryonic tradition of law reviews, this work intends to investigate the cultural project which functioned as the enterprise basis, relating it to the Institution which originated it, and also, inserting it in the nineteenth-century culture of law reviews in Brazil. To this end, the work's first chapter is dedicated on discussing this literary genre consolidation during the 19th century in the continental european juridical culture, creating comparations between this itinerary and its blooming in the latin america context, giving special attention to the cultural assets market's strengthening in Brazil, dated from the same century. The second chapter is dedicated to insert the law review within the institution itself that conceived it, which by its turn is located within a wider framework: the scenary of a law and culture autonomization of a newborn Nation-State, still on construction. The third chapter, finally, dives in the chosen review, analysing its foundation itinerary, its editorial structure and the vehiculed themes' nature. The sources to be analyzed are the published volumes between 1862 - foundation date - and 1888, the last published volume before monarchical regime's end, which coincides with an interruption of the publication and significant changes in the Institute.Veículo de difusão e circulação do pensamento jurídico, laboratório de ensaio para intelectuais juristas e espaço privilegiado para a comunicação científica, a revista jurídica é encarada neste trabalho, em seu berço oitocentista, como um objeto de pesquisa em si considerado, não só como fonte, certamente privilegiada, para pensar a cultura jurídica do século XIX. Utilizando os instrumentais da história cultural dos impressos, optou-se por direcionar o foco da investigação à primeira revista jurídica no Brasil a expandir a ambição e o alcance de sua linha editorial, ultrapassando a marca dos três anos de existência e dedicando-se não apenas a divulgar julgamentos e atos de justiça - como os periódicos jurídicos que a antecederam -, mas sendo repositório de textos doutrinários de maior fôlego: a Revista do Instituto da Ordem dos Advogados Brasileiros. Em que pese tenha sido concebida precipuamente como veículo de divulgação dessa Instituição, já não se tratava meramente de um jornal informativo com difusão local, voltado a divulgar a produção jurisprudencial de Cortes, mas trazia em seu bojo debates de cunho doutrinal envolvendo advogados de destacada atuação no cenário político do Império. Compreendendo sua relevância histórica como elemento de ruptura e inovação em uma tradição embrionária de periódicos jurídicos, o presente trabalho se propõe a investigar o projeto cultural que esteve na base do empreendimento, relacionando-o à Instituição que lhe deu origem e inserindo-o na cultura das revistas jurídicas oitocentistas no Brasil. Para tanto, o primeiro capítulo dedica-se a discutir a consolidação deste gênero literário durante o Oitocentos na cultura jurídica europeia continental, em comparação com o seu florescimento em solo latinoamericano, com especial atenção para o particular itinerário de fortalecimento do mercado de bens culturais no Brasil, datado do mesmo século. O segundo capítulo dedica-se a localizar o periódico dentro da própria Instituição que o concebeu, a qual, por sua vez, também se insere em um cenário mais amplo de autonomização do direito e da cultura em um Estado-Nação recém-emancipado e ainda em vias de construção. O terceiro capítulo, por fim, mergulha no periódico escolhido examinando o itinerário de sua fundação, sua estrutura editorial e a natureza dos temas veiculados. As fontes a serem analisadas são os volumes publicados entre 1862 - data de fundação - e 1888, último tomo publicado antes do fim do regime monárquico, marco temporal que coincide com a interrupção da Revista e significativas transformações no Instituto
