This paper addresses the issue of the postcolonial Algerian legal system built on the heritage of the colonial past with the political willingness to take into account the Algerian juridical culture. We will highlight at least three difficulties. The first one pertains to the discontinuity between the ideological underpinnings of both the colonial and postcolonial state. The second difficulty is methodological to the extent that the postcolonial situation is an attempt to build a new body of rules. However, the legislator can not ignore the influence of the colonial legal heritage consistent with the French tradition that has its own idiosyncrasies.
