La débaathification en Irak : justice transitionnelle ou simple vengeance ?

In the wake of the fall of Baghdad in the spring of 2003, the Americans created a number of mechanisms designed to define the modalities upon which the Iraqis will face the heritage of thirty-five years of dictatorship. The dissolution of the army and the dismantling of the Baath party constitute their centerpiece. The devastative impact of these measures on the reconstruction process was drastic and immediate : the dismissal of thousands of government workers based solely on the fact that they were part of the political party previously in power. Through operating a blatant purge of the administration, the process assumed the form of a collective punishment. Reacting to the strong internal and international criticism, a new law was enacted in 2008 in order to align the Iraqi process with the best practices in terms of transitional justice. Through a critical analysis of its theoretical foundations and its practical implications, this contribution seeks to outline the important cleavage that persists between the new mechanism and the finalities of transitional justice. It appears that beyond superficial alterations, the post-conflict legal system remains irrevocably defective, inadequate and partial. Instead of favouring national reconciliation, it contributes to digging deeper the sectarian divide, leading the country to a deadlock.Au lendemain de la prise de Bagdad au printemps 2003, les Américains mirent sur pied un ensemble de mécanismes destinés à définir les modalités selon lesquelles les Irakiens devaient faire face à l’héritage de trente-cinq ans de dictature. La dissolution de l’armée et le démantèlement du parti Baath en constituent la pièce maitresse. L’effet dévastateur de ces mesures sur l’entreprise de reconstruction fut drastique et immédiat : la mise au ban de plusieurs milliers de fonctionnaires sur le seul fondement d’avoir appartenu à l’ancien parti au pouvoir. En opérant une véritable purge de l’administration, le processus prenait tous les traits d’une punition collective. Pour réagir aux vives critiques internes et internationales, une nouvelle loi fut promulguée en 2008 en vue d’aligner le processus irakien sur les meilleures pratiques en matière de justice transitionnelle. À travers une analyse critique de ses fondements théoriques et de ses implications pratiques, la présente contribution propose de mettre en relief le décalage profond qui persiste entre le nouveau dispositif et les finalités de la justice transitionnelle. Il en ressort qu’au-delà de certaines retouches superficielles, le système de justice post-conflit demeure irrémédiablement défectueux, inadéquat et partial. Au lieu de favoriser la réconciliation nationale, il contribue à creuser en profondeur le clivage sectaire, conduisant le pays dans une impasse.Al Dabbagh Harith.
