La conception de l'enfance en droit international. Illustration par les enfants travailleurs

The objective of this article is to examine how international law spreads, promotes and seeks to universalize one conception of childhood : a Western and hegemonic conception of childhood. The issue of child labor appears to be the best illustration for a critique of this homogenization and the monopolization of the discourses on children for the economic, political and ideological interests of Western states. Therefore, this study will focus on the deconstruction of the rights of the child, the international norms and political discourses held by international organizations related to child labor. Inspired by the pioneering studies conducted in the field of human and social sciences which denounced the universalization of the Western model of childhood, this article intends to do the same within the field of legal science. This research concludes with a study of the claims of Third World working children movements based on the language of law and will reflect on children’s right to participate as an alternative to the hegemonic Western conception of childhood promoted by international law.L’objectif de cet article est d’examiner en quoi le droit international dissémine, promeut et cherche à universaliser une seule conception de l’enfance : une conception occidentale et hégémonique. La problématique du travail des enfants apparaît comme la meilleure illustration pour la remise en cause de cette universalisation, et de la monopolisation des discours sur l’enfance pour les intérêts économiques, politiques et idéologiques des États occidentaux. Ainsi, cette étude se penchera sur la déconstruction des droits de l’enfant, des règles internationales et des discours politiques engagés par les organisations internationales relatifs au travail des enfants. Inspiré par les études pionnières réalisées dans le domaine des sciences humaines et des sciences sociales sur la dénonciation de l’universalisation d’un modèle occidental de l’enfance, cet article entend engager cette même réflexion dans le domaine des sciences juridiques. Cette recherche se conclue par une étude des revendications des mouvements d’enfants travailleurs issus du tiersmonde, revendications fondées sur la langue du droit et qui, nous pousseront à une réflexion sur le droit à la participation des enfants en tant qu’alternative ou espace ouvert de possibilités d’émancipation et de résistance face à la conception occidentale et hégémonique de l’enfance que promeut le droit international.Seccaud Camille.
