The Court of Justice of the European Communities (ECJ) has overturned case law of the International Criminal Court (ICC) concerning the applicability of United Nations Security Council’s regulations and the control of the legality of measures taken for their implementation on grounds of human rights. The said case law clarifies several important aspects of the law that were controversial or ambiguous. This article sets out the state of the law regarding the relationship between public international law and European Community law. It examines the existence of different standards regarding the protection of fundamental rights by European courts and it raises questions about the responsibilities of international organisations and their autonom...
