Infringement of intellectual property rights : a commentary on article 8 of the Rome II regulation

The article deals with the European Parliament and Council of European Union Regulation (EC) No 864/2007 on the law Applicable to Non- Contractual obligations (Rome II Regualtion), particularly with its article 8 which lays down a special Community rule for non-contractual obligations arising out of an infringement of intellectual property rights. the article explores the reasons advocated for the adoption of a uniform choice-of-law rule for infringements of IPRs; the nedd for a uniform conflict-of-law rule at Community level in the light of the persistent diverging national conflit-of-law rules on IPRs infringement in the European Union, in absence of a real risk of forum shopping.it adds some comments on the rigidity of the rule and on the quest for a "single law" approac
