KEBUTUHAN PERLINDUNGAN HUKUM HAK KEKAYAAN INTELEKTUAL PENDESAIN BATIK DI WILAYAH KABUPATEN SIDOARJO (STUDI TERHADAP INOVASI DESAIN BATIK EKSPRESI BUDAYA TRADISIONAL SIDOARJO OLEH ZAINUL CHODIM)

This study aims to determine the needs of batik designers who have innovations in batik which are communal intellectual property in the form of Floklore. This research formulates the problem of 1) How Floklore batik in the Sidoarjo regency, 2) How the innovations in the development of Mr. Zainul Chodim's batik design in Sidoarjo, and 3) How the legal protection needs of the intellectual property of batik designers in the case of Mr. Zainul Chodim. This study uses a juridical-sociological approach to primary data sources obtained from the field and secondary data sources from documentation and legislation and data collection techniques in the form of interviews with Respondents namely Mr. Zainul Chodim, then the research data is analyzed qualitatively. Based on the results of research in Kampoeng Batik Jetis Sidoarjo, there was found Floklore of batik, and there was innovation from Mr. Zainul Chodim, from the innovation there was originality in his work. In conclusion, the innovation outlined in traditional cultural expression batik by Mr. Zainul Chodim has originality in his work so that it forms a new copyright and deserves the protection of copyright, industrial design and brand. Suggestions even though in copyright adheres to a declarative system, but it is better to do a recording at the Directorate General of Intellectual Property Rights, considering that for now the batik of Mr. Zainul Chodim also requires protection from industrial design
