TIDAK BERLAKUNYA NAFKAH ISTRI AKIBAT NUSYUZ DALAM KOMPILASI HUKUM ISLAM TINJAUAN MAQAS{HID SYARI>’AH (Studi Kasus di Desa Belikanget Kecamatan Tambakboyo Kabupaten Tuban)

This study examines the non-enactment of a nusyuz wife's livelihood. In the Compilation of Islamic Law, Nusyuz's wife did not get a living from her husband which was regulated in Articles 80, 83, and 152. Nafah was applied again when the wife returned obediently. The purpose of not living is to make the wife aware and return obedient. But the impact caused by the cessation of his wife's income is detrimental to his wife. The purpose of this study is to examine and analyze the ineffectiveness of living for nusyuz wives according to the Compilation of Islamic Law and to know the impact on wives due to the ineffectiveness of living because of nusyuz. This study was examined using the Maqas theory. In this study the approach used is a sociological juridical approach. This research is a library research with qualitative descriptive data analysis techniques. The results of this study are as follows: First, in the Compilation of Islamic Law, wives who nusyuz from their husbands are not entitled to make a living for their husbands except the needs or things related to children. This can affect the wife in terms of social, economic and psychological. These impacts besides being felt by the wife, the child also did not escape from the victim. In addition, the wife's livelihood again applies when the wife realizes and returns obedient. Second, if viewed from the aspect of Maqas, the impacts caused by the ineffectiveness of living are contrary to the value of benefit
