As inferências negativas na arbitragem internacional

In the present essay, one intends to address the issue of adverse inferences as a consequence of non-compliance with an order to present documents of an arbitral tribunal, in the context of international arbitration. The special nature of this issue in arbitration relates to the need to provide arbitrators, in the absence of ius imperium, with mechanisms that may lead the parties voluntarily to submit documents in their possession. Through the inferences, the arbitral tribunal can infer that the document requested and not presented is unfavorable to the defaulting party, proving the fact raised by the opposing party. It is accepted, almost unanimously, by the doctrine and the jurisprudence of arbitral tribunals and state courts, that this is a power inherent in the exercise of the function of arbitrator, to be applied casuistically and exceptionally, since it is a rule of proof that must be supported by additional means of evidence. In addition, it is stipulated in provisions of some domestic and international arbitration legislation, arbitration rules and other non-binding instruments. It is worth noting that the IBA Rules on Taking of Evidence in International Arbitration provide, specifically in article 3, a series of prerequisites to which the opposing party must obey when producing the documents of application. Once ordered to produce, if the requested party fails to present its document, Article 9 establishes as a consequence, the possibility for the arbitral tribunal to draw an adverse inference to its version of the facts. In this process, and not only when the IBA Rules apply, arbitrators must, however, take into account certain criteria of application in the particular case, proposed by the doctrine and based upon the guidelines usually followed in arbitration awards. The purpose is to safeguard the principles of due process, in particular with regard to equality and the rights of the parties to present their cases, as well as their expectations, remembering that arbitration procedure is more flexible and informal.No presente trabalho, pretende-se abordar a temática das inferências negativas como consequência do incumprimento de uma ordem de apresentação de documentos de um tribunal arbitral, no contexto da arbitragem internacional. A especialidade deste regime na arbitragem prende-se com a necessidade de dotar os árbitros, na falta de ius imperium, de mecanismos passíveis de conduzir as partes, voluntariamente, a apresentar documentos exclusivamente na sua posse. Através das inferências, o tribunal pode deduzir que o documento solicitado e não apresentado é desfavorável à parte faltosa, provando o facto suscitado pela parte requerente. É aceite, quase unanimemente, pela doutrina e pela jurisprudência, arbitral e estadual, que este é um poder inerente ao exercício da função de árbitro, a aplicar casuística e excecionalmente, por se tratar de uma regra de prova que deve ser suportada por elementos de prova adicionais e consistentes. Além disso, vem previsto em disposições de alguns diplomas legais de arbitragem, domésticos e internacionais, Regulamentos arbitrais e outros instrumentos não vinculativos. Destaca-se, em matéria de prova, as Regras da IBA sobre a obtenção de provas na arbitragem comercial internacional, que prevê, especialmente, no seu artigo 3.º, uma série de requisitos a que um requerimento de produção de documentos em posse da parte contrária deve obedecer. Uma vez ordenada a sua produção, se a parte requerida falhar na apresentação do respetivo documento, o artigo 9.º estabelece, como consequência, a possibilidade de o tribunal retirar uma inferência desfavorável à sua versão dos factos. Neste processo, e não só quando são aplicáveis as Regras da IBA, os árbitros devem, no entanto, ter em consideração alguns pressupostos de aplicação no caso concreto, devidamente propostos pela doutrina com base na reunião de orientações habitualmente seguidas em sentenças arbitrais. O objetivo é salvaguardar os requisitos mínimos do processo equitativo, sobretudo relacionados com a igualdade e os direitos de defesa das partes, bem como as suas expectativas, sem nunca esquecer que a arbitragem se caracteriza por um processo mais flexível e informal
