LOS TRIBUNALES CONSTITUCIONALES DE SUDAMÉRICA A PRINCIPIOS DEL SIGLO XXI

This article examines the development of judicial review in the countries of South America, considering the cases of specialized constitutional courts as well as cases of non-specialized judicial review, and mixed cases. Having thus described the status of judicial review in the region, both substantive and formal criteria are deployed to identify those countries whose judicial review systems correspond to the notion of a constitutional court. Finally, an organizational and functional analysis of these courts is provided.Este artículo analiza el desarrollo de la jurisdicción constitucional en países de América del Sur, atendiendo a una combinación de criterios formales y materiales, que tienen jurisdicción constitucional concentrada, difusa o mixta, a partir del cual se identifican los países que tienen órganos jurisdiccionales que responden al concepto de tribunales constitucionales, atendiendo a elementos tanto materiales como formales. Esta identificación permite realizar más tarde, el análisis orgánico y funcional de dichos tribunales, independientemente de los demás órganos que desarrollan jurisdicción constitucional en nuestro subcontinente
