¿Qué tan fuerte es el legislativo en Ecuador?: Un estudio de sus poderes constitucionales desde el retorno a la democracia.

This article proposes a study about the institutional power the legislature has had in Ecuador. For this, a de iure analysis is carried out, evaluating the variations that the Legislative function has had in its control capabilities (corresponding to the control and sanctions that it can made on the Executive and other public bodies), legislative (both internal and to the Executive), and political capacities (referred to the appointment of public officials). The three constitutional designs that have been made in Ecuador since the return to democracy (1979, 1998 and 2008) are taken as an empirical reference. This allows observing that, although the Ecuadorian legislature has been losing political designation power, it has been gradually strengthened in its control capacities, while in the legislative capacities it has remained without major alteration in the three constitutional designs studied.Este artículo propone un estudio sobre el poder institucional que ha tenido la legislatura en Ecuador. Para ello, se realiza un análisis de iure, evaluando las variaciones que ha tenido la función Legislativa en sus capacidades de control (correspondientes a la fiscalización y sanciones que puede ejercer sobre el Ejecutivo y otros órganos públicos), legislativas (tanto internas, como frente al Ejecutivo), y las capacidades políticas (referidas a la designación de funcionarios públicos). Se toma como referente empírico los tres diseños constitucionales que se han tenido en Ecuador desde el retorno a la democracia (1979, 1998 y 2008). Esto permite observar que, si bien la legislatura ecuatoriana ha venido perdiendo poder de designación política, se ha fortalecido gradualmente en sus capacidades de control, mientras que en las capacidades legislativas se ha mantenido sin mayor alteración en los tres diseños constitucionales estudiados. &nbsp
