Fishing Rights Under Various Acts and Legislations With Special Emphasis on Ornamental Fish Trade in India

No poster available.Fisheries management is an issue that draws out conflicting responses\ud about the role of the state, the market and civil society over the\ud management of natural resources. As an individual, anybody who is\ud exploiting the common resource will not think of any conservation because\ud the benefits in the short term are much better, creating a conflict of interests\ud between the rational individual and what seems rational for the community.\ud eg. Coastal trawl fishery in India. In this paper the regulatory framework on\ud inland water fishing in India is discussed which includes the collection of\ud indigenous species for ornamental fish trade. The need for limiting the\ud harvesting of fish and thus end open access in fisheries became widely\ud recognized. In India, the National and All State Governments are in the\ud process of amending the Legal Frame Work in tune with the Code of\ud Conduct for Responsible Fishing of the FAO. Some of the State\ud Governments have already achieved this goal. India is set to have Green\ud Certification for each and every species of fresh water ornamental fishes\ud and registration of native species under the Geographical Indications of\ud Goods (Registration and Protection) Act, 1999 for effective international\ud trade and tracking of the source of the products, its characteristics including\ud IUCN status and GI. Indian producers and exporters are also moving\ud towards market orientation for better markets and acceptance of their\ud products. At present India has no legislation on the importation or\ud introduction of aquatic organisms nor is there a proper quarantine\ud procedure in place for imported fishes. However, the country is now on its\ud way to have an efficient regulation and management policy for exotic\ud species introduction and quarantine procedure for both imported and\ud exported ornamental fishes.
