When the much-debated Treaty of Lisbon finally came into force on the 1st of December 2009, it introduced “foreign direct investment” as a new explicit competence within the European Union’s (“EU”) Common Commercial Policy (“CCP”). Albeit heartily welcomed by, inter alia, the European Commission, this extension of the EU’s exclusive external powers is not unproblematic. The most fundamental issue is that Article 207(1) of the Treaty on the Functioning of the European Union (“TFEU”) leaves considerable leeway for different interpretations on the scope of the Union’s new foreign investment policy powers.
