La systématisation du droit et la théorie du ius gentium comme droit du genre humain chez François Connan

International audienceThe legal humanism of the 16th century, opposing the mos gallicus to the tradition of the mos italicus, is characterized by philological and historicist approach of the corpus of Roman law and by the will to find the letter and spirit within. The work of François Connan, immediately celebrated in his time and greatly influencing the later jurists, is a key moment in the systematization of law, which he is the first to accomplish. By focusing on the exposition of the first principles of law and to deduce from it the whole legal order, he transforms presentation and meaning of the law. His rational exposition of the law leads him to expose the idea that men share a community of law, the ius gentium, governing the whole Earth. The totus orbis is described as a politically organized city whose essentials components are the men divided into nations. Thus Connan formulates a modern theory of cosmopolitanism based on the idea that men belong to a local community open on the others. Without being “the same”, the stranger is not circumscribed by a border; politics and law unfold in the horizon of a common world that should ensure peace. This article is devoted to these two major ideas of the legal and political thought.L’humanisme juridique du XVIe siècle, opposant à la tradition du mos italicus le mos gallicus, se caractérise par une approche philologique et historiciste du corps de droit romain et par la volonté d’en retrouver l’esprit. L’œuvre de François Connan, immédiatement célébrée en son temps et influençant fortement les juristes postérieurs, constitue un moment clé de la systématisation du droit, qu’il est le premier à accomplir. En s’attachant à exposer les principes premiers du droit et à en déduire l’ensemble de l’ordre juridique, il transforme la présentation et la signification du droit. Son exposition rationnelle du droit le conduit en outre à exposer l’idée que les hommes partagent une communauté de droit, le ius gentium, régissant l’ensemble de la Terre. La totus orbis est décrite comme une cité politiquement organisée dont les composantes essentielles sont les hommes répartis en nations. Connan formule ainsi une théorie moderne du cosmopolitisme reposant sur l’idée que les hommes appartiennent à une communauté territoriale ouverte sur les autres. Sans être « le même », l’étranger n’est pas circonscrit par une frontière ; la politique et le droit se déploient dans l’horizon d’un monde commun dont il faut assurer la paix.
