La jeunesse déviante entre ordre moral et raison expertale. Production du droit et politiques publiques de protection de la jeunesse sous le régime de Vichy

Law-Making and Child Welfare Public Policy under the Vichy RegimeThe Vichy regime was a turning point in the history of public policy of child welfare. It inherited republican debates on the reform of the juvenile justice system. Beyond the alarmist rhetoric of a totalitarian regime maintaining an ambiguous relationship with “its” youth, public policies of child welfare were elaborated in a complex process, involving private and public sector reformers, moral entrepreneurs and scientists, lawyers and civil servants, judges and administrators. Thus, a “science of government” targeting pri- marily “unadjusted” childhood was developed in the shade of ministerial offices, in the context of increasing intervention of the bureaucratic state. Employing a socio-historical approach, this article intends to take a closer look at the very making of the norms concerning at-risk children. Tournant dans l’histoire des politiques publiques de protection de la jeu- nesse, le régime de Vichy hérite de débats républicains sur la nécessaire refonte de la législation de la justice des mineurs. Par-delà les discours alarmistes d’un régime totalitaire entretenant des rapports ambigus avec « sa » jeunesse, les politiques publiques de protection de l’enfance s’éla- borent selon un processus complexe, associant secteur privé et secteur public, réformateurs militants et experts scientifiques, juristes et fonction- naires, magistrats et administrateurs. S’élabore ainsi, dans l’ombre des bu- reaux ministériels, une « science du gouvernement » dont l’enfance « irrégu- lière » est une cible privilégiée, dans un contexte d’intervention croissante de l’État bureaucratique, dont l’article analyse, au plus près, la pratique de fabri- cation des normes.
